These Terms of Service ("Terms") govern your access to and use of the Kafe Xpress website and services (the "Services") operated by Anthropos Automation Service LLC, a Wyoming limited liability company doing business as Kafe Xpress ("Kafe Xpress", "we", "us"). By using the Services or placing an order you agree to these Terms, our Privacy Policy, Refund & Returns Policy and Shipping Policy, which are incorporated by reference. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) to purchase. You are responsible for maintaining the confidentiality of your account and for all activity under it, and you agree to provide accurate, current information.
2. Products, sourcing and descriptions
Kafe Xpress is a coffee brand. Our coffees are sourced, roasted and fulfilled through a network of roasting, co‑packing and logistics partners selected and managed by Kafe Xpress; products are sold under the Kafe Xpress brand and we remain your seller of record. Origin, region, process, altitude, tasting notes, certifications and similar attributes are provided in good faith based on information from our supply partners and may vary by harvest and lot. Tasting notes describe natural flavor characteristics and are subjective; "flavored" coffees are clearly labelled as such. Reserve and limited lots are available only while supplies last and may not be re‑offered. Product images, including packaging renders, are illustrative and may differ from the delivered item. We reserve the right to limit quantities, discontinue products, and correct errors in descriptions or pricing at any time.
3. Pricing, taxes and payment
Prices are shown in the store currency and may change without notice; the price charged is the price displayed at checkout. Applicable taxes, duties and shipping are calculated at checkout or, for international orders, may be collected by the carrier on delivery. You authorize us (and our payment processors) to charge your payment method for all amounts due. We may refuse or cancel any order, including for suspected fraud, pricing errors or unavailability; if charged, you will be refunded.
4. Subscriptions (automatic renewal)
By starting a subscription you authorize recurring charges to your payment method at the cadence you select (for example every 2, 4 or 6 weeks) at the then‑current subscription price, until you cancel. You can skip, pause, change or cancel any time from your account or by contacting us; changes apply to orders not yet processed for roasting. We will notify you of material price changes before they take effect. Subscription discounts apply only while the subscription is active. Failed payments may result in suspension of the subscription.
5. Gifts and bundles
Gift boxes and discovery packs are configurations of our standard products. Gift messages and requested delivery dates are provided on a best‑effort basis. You represent that you have the recipient's permission to provide their contact and delivery details.
6. Business, wholesale and corporate orders
Wholesale and corporate pricing is provided by quote only and is not available through standard checkout. Quotes, order confirmations and any written supply terms govern such orders and prevail over these Terms where they conflict.
7. Shipping, risk and title
Delivery estimates are not guaranteed. Title and risk of loss pass to you when the carrier accepts the shipment, except that we will assist with claims for parcels lost or damaged in transit as set out in our Shipping and Refund policies.
8. Intellectual property
The Kafe Xpress name, KX mark, KX Seal, "The World, Roasted." tagline, logos, packaging designs, website content, images and software are owned by or licensed to Anthropos Automation Service LLC and protected by intellectual‑property laws. You may not copy, modify, distribute or create derivative works without our prior written consent. Third‑party marks belong to their owners.
9. User content and reviews
If you submit reviews, comments or other content, you grant us a non‑exclusive, worldwide, royalty‑free, perpetual license to use, reproduce and display it in connection with the Services and our marketing. You represent that your content is accurate, lawful and does not infringe third‑party rights. We may remove content at our discretion.
10. Acceptable use
You agree not to misuse the Services, including by attempting unauthorized access, scraping, interfering with operation, submitting false orders or chargebacks, or using the Services for any unlawful purpose.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON‑INFRINGEMENT, EXCEPT FOR ANY WARRANTIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW. Coffee contains caffeine; consume responsibly. Allergen information is provided where available — please review product descriptions before purchase.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KAFE XPRESS, ANTHROPOS AUTOMATION SERVICE LLC AND THEIR MEMBERS, OFFICERS, EMPLOYEES, PARTNERS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted.
13. Indemnification
You agree to indemnify and hold harmless Kafe Xpress and Anthropos Automation Service LLC from claims, damages and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your content, or your misuse of the Services.
14. Governing law; disputes; arbitration
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict‑of‑law rules, and by applicable U.S. federal law. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small‑claims court or seek injunctive relief for intellectual‑property misuse. YOU AND KAFE XPRESS WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting these Terms. If you are a consumer in a jurisdiction whose laws do not permit mandatory arbitration or class waivers, those provisions do not apply to you, and you retain the mandatory protections of your local law.
15. Changes; severability; entire agreement
We may update these Terms by posting a revised version with a new "Last updated" date; continued use after changes constitutes acceptance. If any provision is held unenforceable, the remainder stays in effect. These Terms, with the policies incorporated above and any order‑specific terms, are the entire agreement between you and us regarding the Services. Our failure to enforce a provision is not a waiver.
